Terms of Use

Version: 2026-10-16

  1. Agreement - These terms are an agreement between you and AI Eh By Solutions, a Canadian company that operates You Shouldn’t Have (“the app”, “we”, “us”): the web app at app.youshouldnthave.ca, the website youshouldnthave.ca and the emails and notifications we send. By creating an account or taking part in an event, you accept these terms. Our Privacy Policy explains how we handle personal information.

  2. Who can use the app - You must be at least 14 years old to create an account. If you are under the age of majority where you live, you need the permission of a parent or guardian. An organizer may include a child under 14 in an event only with the permission of the child’s parent or guardian, and must use the parent’s or guardian’s email address, never the child’s.

  3. What the app does - You Shouldn’t Have helps groups organize gift exchanges. An organizer creates a Secret Santa (each giver is matched to one person) or a gift registry (guests claim items). The app sends the invitations, makes the Secret Santa draw, carries anonymous questions and answers, looks up the gift links people paste, suggests places to buy, estimates delivery times and sends reminders.

  4. Accounts - You sign in with Google, with your email address and a password, or with Apple where it is offered. Accounts that use the same verified email address are linked. Each account is for one person. Keep your sign-in secure; you are responsible for what happens under your account. Tell us right away at contact@youshouldnthave.ca if you think someone else has used it.

  5. Organizers - If you organize an event, you confirm that you have permission from the people you add to give us their names and contact details (email addresses and any phone numbers) and to have us email them about the event. You are responsible for the event details you enter. If you add a shipping address to a registry, it is shown to the event’s organizers and to the guests who have joined. Deleting an event deletes it, with its people, wishlists, messages and items, for everyone.

  6. Secret Santa pairings - Pairings are made at random by the app and kept sealed: no organizer, co-organizer or AI Eh By Solutions staff member can read them in normal use. The person who gives to you sees your name, interests and wishlist. An organizer can reveal one person’s match only through the troubleshooting tool, after two confirmations, typing that person’s name and giving a written reason. Every reveal is logged and shown to all organizers of that event. Use it only to fix a real problem.

  7. Registries - Organizers see who claimed or bought each item; other guests see only how many are still available. Anyone with an open registry link can see the event title, date and description, the organizer’s first name and the items, but not who claimed them.

  8. Your content - Wishlists, notes, messages, links and event details you add remain yours. You give us a non-exclusive, royalty-free licence to store, copy, display and send that content only as needed to run the app for you and the people in your events, for as long as it is in the app. You are responsible for your content and confirm that you have the right to share it. We may remove content that breaks these terms or the law.

  9. Anonymous messages - Questions and answers between a giver and their recipient are anonymous to the recipient. Do not use them to harass anyone, to reveal identities against the rules of the exchange or to send unlawful content.

  10. Acceptable use - Do not misuse invitations or messages, send spam or advertising through the app, impersonate others, enter people’s information without their permission, post unlawful, hateful or infringing content, collect other users’ information, scrape the app, or try to break its security or the secrecy of pairings.

  11. Gift links, prices and delivery estimates - When you paste a link, our servers fetch that page to read the product name, picture and price, except Amazon pages, which we never fetch: Amazon items show the product name from the link, no picture and no price, with “See price on Amazon”, and their price counts as unknown for budget checks. Product details, prices and stock come from retailers’ pages and can be wrong or out of date; prices are shown with the date we checked them. Delivery windows, order-by dates and “on time”, “tight” or “late” labels are estimates based on typical times we set for each store. They are not information from the store and not guarantees. We never invent a price; an unknown price is shown as unknown. Check with the retailer before you buy. Purchases are made with the retailer, under the retailer’s terms and privacy policy; we are not a party to them and are not responsible for retailers’ products, prices, availability, shipping, delivery, returns or websites.

  12. Affiliate links - Some links to retailers may be affiliate links: when we take part in a retailer’s affiliate program, we may earn a commission when you buy through those links, at no extra cost to you. Affiliate status never changes the price you pay. Places to buy that are affiliate links are listed first, ahead of other stores, even stores showing a lower price, and the app says so next to the offers.

  13. Emails and notifications - We send emails about events you organize, joined or were invited to: invitations (sent at an organizer’s request and naming that organizer), match notices, questions and answers, reminders and, only if you turn it on, a daily registry summary. We do not send marketing emails. Every email identifies You Shouldn’t Have and AI Eh By Solutions and has an unsubscribe link for that type of email. Push notifications are sent only if you turn them on; you choose each type in Settings.

  14. Calendars - You can add an event to your calendar or subscribe to a private calendar feed. Anyone who has your feed link can see your event dates, so keep it private; you can replace or remove it in Settings. If you connect Google Calendar (when offered), we add each event you organize or joined to your Google Calendar, keep it up to date and remove it when the event is deleted or you leave it; we never touch your other events. You can disconnect at any time: we then remove the events we added and our access.

  15. Price - The app is free to use. If paid features are ever offered, we will show the price and terms before you choose them and will never charge you without your explicit agreement.

  16. Availability and changes to the app - The app is provided “as is” and “as available”. We may change, suspend or stop features. If we decide to close the app, we will give you reasonable notice so you can download your data.

  17. Disclaimer - To the extent the law allows, we give no warranties or conditions beyond those the law requires, including that the app will be uninterrupted or error-free or that product, price or delivery information is accurate.

  18. Limitation of liability - To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, lost profits or lost data, or for the products, services or acts of retailers, other users or third-party services, and our total liability for all claims relating to the app is limited to 100 Canadian dollars. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or your rights under consumer protection law, including the Quebec Consumer Protection Act.

  19. Ending - You can stop at any time by deleting your account (Settings > Delete account, or the account deletion page at youshouldnthave.ca/delete-account). We may suspend or close an account that breaches these terms. The Privacy Policy and the account deletion page explain what happens to your data. Sections 11, 12, 17, 18 and 21 continue to apply after your account ends.

  20. Changes to these terms - We post every change here with a new version date. For a material change, we will tell you in the app or by email before it takes effect. If you keep using the app after that, the new terms apply; if you do not agree, you can delete your account.

  21. Law and language - These terms are governed by the laws of [OWNER TO CONFIRM: province or territory where AI Eh By Solutions is based] and the federal laws of Canada that apply, and disputes go to the courts of that province or territory. This does not remove any right you have under the consumer protection laws of the place where you live, including the right of Quebec consumers to go to the courts of Quebec. These terms are available in English, French and Spanish, and each version has the same effect; the French version is provided in line with the Quebec Charter of the French Language.

  22. Contact - AI Eh By Solutions, [OWNER TO CONFIRM: mailing address], contact@youshouldnthave.ca.
